By case law, any optician, optometrist, or ophthalmologist is free to import eyewear originating anywhere into California and sell it in the state.
However, eyewear companies cannot advertise and sell prescription glasses in the same place that customers get their eyes examined.
Only optometrists and ophthalmologists can provide optical one stop shopping, i.e. sell prescription eyewear and provide eye exams in the same location. Opticians cannot.
No optometrist can have any membership, proprietary interest, co-ownership, landlord-tenant relationship, or any profit-sharing arrangement in any form, directly or indirectly, with licensed opticians (RDO ( which stands for Registered Dispensing Opticians, which is actually the business (an individual, corporation or firm which employs lens dispensers), RSLD (Registered Spectacle Lens Dispensers), or RCLD (Registered Contact Lens Dispensers) in California.
It is thus illegal for an optician to furnish or advertise the furnishing of services of an optometrist, or a physician and surgeon or to directly or indirectly employ or maintain on or near the premises used for optical dispensing, an optometrist, a physician and surgeon, or any other practitioner for the purpose of any examination or treatment of the eyes.
Case law, however, has allowed a doctor’s office to be adjacent to an optician’s office when the money paid by patients for eye exams did not go to the optician, it went to and was kept by the doctor, when the optician did not exercise control over the doctor, and when the optician did not maintain the doctor’s office.

The Contact Lens Rule: A Guide for Prescribers and Sellers
The Fairness to Contact Lens Consumers Act gives people certain rights, including the right to shop around when buying contact lenses. The Act also imposes duties on contact lens prescribers and sellers, and requires the Federal Trade Commission (FTC) to develop and enforce implementing rules. In 2004, the FTC issued the Contact Lens Rule to spell out the Act’s requirements. In 2020, the FTC amended the Rule.
The Contact Lens Rule requires prescribers to give patients a copy of their contact lens prescriptions at the end of a contact lens fitting, even if the patient doesn’t ask for it. If you are willing to sell lenses to the patient, the fitting is complete and you must provide them with the prescription. Similarly, if you are simply renewing a patient’s prescription, you must provide the prescription immediately upon completion of the examination.
A patient who wants to buy contact lenses from another seller may give a copy of the prescription to that seller. If a patient doesn’t give the prescription to that seller, the seller must get the prescription information from the patient and send it to a prescriber to verify before selling the lenses.
There is a great deal more to the Contact Lens Rule which we can provide to an optician upon being retained as their eyewear or eyeglasses business attorney. It is quite complex and can cause problems for an optician if the provisions in the Rule are not followed.
